We make reasonable efforts to present products accurately. Color, texture, scale, and handmade variation may appear differently across devices or individual pieces.

An order may be declined or canceled where reasonably necessary because of inventory error, pricing error, suspected fraud, payment failure, shipping limitation, legal restriction, or inability to fulfill the order. If payment has been captured for a canceled order, the appropriate refund will be issued.

Prices are shown in United States currency unless stated otherwise. Applicable taxes, shipping charges, duties, and fees will be displayed or described where available.

1. Product Characteristics and "As-Is" Sales
Any products sold on an "as-is" and "as available" basis. Because some of the art created here uses real and/or natural materials (including but not limited to wood, stone, pinecones, moss, feathers, and dried plants), you acknowledge and agree that:

• Natural Variations: Items naturally vary in color, texture, shape, and size. Products will not perfectly match the preview photos on our website.

• Natural Aging: Natural components may change color, fade, crack, or decay over time due to environmental factors like sunlight, humidity, and temperature. We are not responsible for this normal aging process.

• Allergen Notice: Our products contain natural elements that may trigger allergic reactions in sensitive individuals. It is the customer's responsibility to review product descriptions before purchasing.

2. Limitation of Liability
To the maximum extent permitted by applicable law, Olive & Edith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or connected to your purchase or use of our products.

In no event shall our total financial liability to you for all claims exceed the exact amount you paid to Olive & Edith for the specific product that gave rise to the claim.

You agree to defend, indemnify, and hold harmless Olive & Edith from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your misuse of our products or your violation of these Terms and Conditions.

These Terms and Conditions, and any dispute arising from your use of this website or purchase of our products, shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of these terms must be brought exclusively in a state or federal court located in Tarrant County, Texas, and you consent to the personal jurisdiction of these courts.

5. Dispute Resolution: Binding Arbitration and Class-Action Waiver

• Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

• Class-Action Waiver: You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis. You explicitly waive any right to bring or participate in a class-action lawsuit, collective arbitration, or any other representative legal action.
